well, there are 2 sources of islamic law which are written n unwritten law..For those who r studying in islamic school might be very good at this..what are they my beloved friends??? Ha..surely the written sources are our Holy Quran, Sunnah, ijma', n qiyas. What about the unwritten law? They are..ijtihad, al-istihsan, al-masalihal mursalah n al-'urf...
actually i,m trying to say here that this in important things that should not be forgot by us. It is not just a silivers n our study, but it is about our deen. As an Islamic student we must be very good at this. Not common people are good in this field of knowledge. For my friends in smkab, kisas n mmps, we r the one that will be asked by others regarding these sources of law.
Let's go through 1 by 1..
al-Quran-main source of Islamic law. All basic law are mentioned in the Holy Quran. So, whatever Islamic law to be made must be referred to the Quran first. It is the main guide to Islamic law.
Sunnah- It is what prophet Rasulullah did,said n declare. Besides, It also explain further about the laws contain in the Holy Quran.
Ijma'- Ijma' is whenever there's a group of muftis discuss to make law of the things that do not occur during Rasulullah's time. For instance, they would decide on yoga, smoking and stem cell, whether they are legal or illegal in Islam.
Qiyas- It is practised by searching for the 'illah for some cases. For example, drinking alcohol is illegal in Islam. why?? Because it cause fuddle/ 'mabuk' where people fail to think wisely. What about the drug addiction? So, we find the 'illah between the alcohol n drug which cause people fail to think wisely. So, drug addiction is not allowed in Islam.
Ijtihad- There's a story when Rasulullah send a sahabt to a place which is far apart from Mekah. Rasulullah ask him, "If you are not sure about something, to who are u going to refer since that there are no other sahabat or even me in there?" Then he answered, " al-Quran n sunnah" Rasulullh asked again,"What about if it is not stated in al-Quran n as-Sunnah?" He said, " I'll do ijtihad (thinking based on his knowledge about Islam)".
Istihsan-more towards completing human needs.
al-masalihal mursalah- order made in which to ensure the better for the future. For example, khalifah abu bakar asked to collect the Quran into a mushaf to make sure that we nowadays would be able to refer to it as a main guidance in Islam. The current examples are traffic lights to reduce accidents.
Al-'urf-mostly refer to the custom practices such as marriage procedure. Islam element would assimilate with the custom element. Well, actually, to practise Islam is easy.
